What was reported
According to Reuters, Shein agreed to pay $100 million to settle the FTC's investigation over delivery delays and other customer complaints. Consumers filed more than 12,000 complaints about Shein covering more than $11 million in purchases between January 2020 and June 2026, according to FTC records Reuters reviewed. Some described packages marked as delivered that never arrived and customer service that did not fix it. Reuters said it could not verify the substance of the complaints or whether they were resolved.
Shein said it had reached a constructive outcome with the FTC and would share more information soon. An FTC spokesperson declined to comment, and we found no FTC press release or case listing for Shein as of November 5. Shein had warned in July filings for its Hong Kong listing that the US probe could lead to significant fines, and Reuters reported its shares were 22% below their September 1 listing price.
- Reported amount: $100 million, about 44% of Shein's Q2 profit (Reuters).
- Complaints: 12,000+ covering $11M+ of purchases, January 2020 to June 2026.
The rule behind delivery cases
Reuters did not say which rule the FTC applied to Shein. But the FTC's earlier delivery cases it cited, Fashion Nova at $9.3 million in 2020 and Crocs owned Hey Dude at $1.95 million in 2023, both involved shipping promises and delay notices. Those are the core of the FTC's Mail, Internet, or Telephone Order Merchandise Rule, often called the 30 day rule.
The FTC's business guide says a seller must have a reasonable basis for any shipping time it states, or for shipping within 30 days if it states none. If an order cannot ship on time, the seller must ask for the customer's consent to the delay, give a revised date and offer cancellation with a full refund. If consent is not given, the seller must refund without being asked, generally within seven working days for card payments, and cannot substitute store credit. Civil penalties run up to $53,088 per violation.
FTC shipping rule checklist
- Reasonable basis for ship times
- 30 days if no time stated
- Delay notice with new date
- One click cancel option
- Card refund in 7 working days
- No store credit as refund

So what: per order penalties add up fast
The risk is not one big promise but thousands of small ones. Each late order without a proper delay notice can count as a violation, so the exposure scales with order volume, exactly when Black Friday and Cyber Monday volume peaks.
Worked example, illustrative numbers: a Shopify brand ships 2,000 Cyber Week orders with a stated 3 to 5 day delivery. A warehouse backlog delays 10%, or 200 orders, and no delay emails go out. At the FTC's maximum, 200 violations would be $10.6 million of theoretical exposure. Real penalties are usually far lower and negotiated, but the bigger everyday cost is chargebacks, refunds and reviews. The fix, an automated delay email with a cancel link, costs almost nothing. What sellers should do
These steps fit brands shipping their own orders from a website, from Seller Fulfilled Prime or FBM, or on other marketplaces:
- Ops lead: list every place you state a delivery or ship time, from product pages to checkout and ads, and check each against your real handling time this week. Metric: share of orders shipped within the stated time.
- Customer service lead: set an automated delay email that gives a new date and a one click cancel and refund option. Metric: share of late orders that got a notice before the promised date.
- Finance lead: confirm card refunds on cancelled orders go out within seven working days and never as store credit. Metric: median refund time.
- Marketplace manager: on Amazon, keep handling times in Seller Central realistic for peak and watch late shipment rate in Account Health. Metric: late shipment rate under 4%.
- Founder: write your holiday shipping cutoff dates on the site now, and move them earlier if your carrier warns of delays. Metric: orders placed after cutoff that arrive late.
FTC delivery cases
When this does not apply
For FBA orders, Amazon controls the delivery promise and the shipping, so the day to day exposure sits with Amazon, not the seller. The Shein amount is also a press report: until the FTC publishes an order, the exact terms, any admission and any conduct rules are unknown, so treat it as a warning, not a precedent. This is not legal advice; check with counsel for your situation.
